Terms of Services
1. Introduction
These Terms and Conditions govern the use of dispatch services provided by Unity Dispatchers (referred to as “Unity,” “we,” “us,” or “our”). By using our services, you agree to comply with these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, you must not use our services.
2. Services
Unity Dispatchers provides dispatch services to carriers and owner-operators (“Clients”) in the transportation industry. Our services include but are not limited to, booking loads on behalf of Clients, finding suitable freight matches, handling paperwork with shippers/brokers, setting appointments, and providing access to rates and shippers.
3. Client Obligations
Clients must provide Unity Dispatchers with necessary documentation, including a copy of their certificate of authority (MC), drivers’ licenses for owner operators and drivers, proof of insurance certificates, signed W-9 form, signed power of attorney, completed carrier profile sheet, and a signed dispatch agreement form.
Clients are responsible for their own equipment and must reach out to 3rd party resources if needed. Clients must also communicate load information to drivers and inform Unity Dispatchers about any issues regarding the load.
4. Payment
Clients will be charged a deposit that serves as payment towards their last week of service. Payment for dispatch services is due weekly at a rate of 8.5% of the gross load amount based on all rate confirmations received from brokers/shippers. Payment is due on Tuesday by 5:00 pm. Failure to make payment may result in a pause of services and a reinstatement fee.
5. Liability
Unity Dispatchers is not responsible for billing issues between clients and brokers/shippers, load problems during line haul, advances, handling and storage of paperwork, DOT compliance issues, or SPIKE Insurance. Clients indemnify and hold Unity Dispatchers harmless from any liabilities, damages, fines, penalties, costs, claims, demands, and expenses arising from the transportation pursuant to the agreement.
6. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States.
7. Changes to Terms and Conditions
Unity Dispatchers reserves the right to amend or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website or notifying clients. It is the client’s responsibility to review these Terms and Conditions periodically for updates.
